Which Online Trust Services Actually Record the Deed?
Most online trust services hand you the documents and stop. The deed, the step that actually keeps your house out of probate, is left to you or sold separately. Here is who does what.
The short answer
As of October 2026, of the major online services, Mantle is the one where the deed is part of the product: drafted free with the trust, then notarized and recorded with the county in the $499 activation. LegalZoom files deeds through a separate service from $249 plus fees. Trust & Will refers you to a partner at $140 per deed plus fees, with notarization extra. Free will services generally do not touch the deed at all.

Why the deed is the whole point
A living trust avoids probate for one reason: the trust, not you, owns the asset when you die. For a house, ownership is whatever the recorded deed says. If the deed still names you personally, the trust document in your drawer changes nothing, and the house goes through probate.
This is not a rare mistake. It is the normal outcome of buying documents online. The documents arrive, the signing is a hassle, the county recorder is a bigger hassle, and the deed never gets done. A signed trust is a promise. A recorded deed is a fact.
What an unrecorded deed costs in California
Statutory probate fees under Probate Code §10810 on a $1,000,000 gross estate: about $23,000 to the attorney and $23,000 to the executor, before court costs, and 12 to 18 months of waiting. Estimate yours →

What “we record the deed” should include
When you compare services, ask these four questions. A yes to all four is what it takes for the house to actually be in the trust.
- 1. Is the deed drafted from my trust's exact name and date, with the legal description from my current deed? A deed that misnames the trust can be rejected or cloud title later.
- 2. Is notarization part of it? Every grantor on title has to sign before a notary. California recognizes a remote online notarization performed by a notary commissioned in a state that allows it (Civil Code §1189), which is how an online video notary session works for a California deed.
- 3. Who files with the county recorder, and who files the Preliminary Change of Ownership Report with it? In California the PCOR is expected with the deed; without it the recorder charges an extra fee and the assessor may start a reassessment inquiry.
- 4. Do I get the recorded deed back, with the recorder's stamp? That stamped copy is the proof. Keep it with the trust.
How Mantle does it
Mantle drafts the trust transfer deed at the same time as the trust, from the answers you give Margot, and reads your current deed's vesting so the names match. The documents are free to draft, review and download. If you want the execution handled, the $499 activation covers the online notary session for every grantor, recording the deed and PCOR with your county, and a walkthrough of each bank and brokerage account, one institution form at a time. Mantle does not retitle accounts for you; it guides you through each one.
If you would rather file the deed yourself, the free download includes the deed and a signing guide that says exactly what your county needs.
Common questions
Which online trust services record the deed for you?
As of October 2026: Mantle prepares the trust transfer deed free with the trust and records it with the county as part of its $499 activation, which also includes the online notary session. LegalZoom sells a separate deed transfer service from $249 plus county fees that files the deed once you have had it notarized. Trust & Will refers you to a partner, Bundle, at $140 per deed plus recording fees, with notarization another $100. FreeWill and most free will services do not offer deed recording.
Does a living trust avoid probate if the house was never transferred into it?
No. A trust only controls what it owns. If the deed still names you personally, the house is a probate asset no matter what the trust says. In California, a $1,000,000 home alone produces roughly $46,000 in statutory attorney and executor fees.
What does it cost to record a deed myself in California?
Typically $100 to $150 all in: county recording fees of roughly $20 to $150, plus a notary at $15 per signature or more, plus the Preliminary Change of Ownership Report, which is free but required. The cost is small; the problem is that most people never get around to it.
Does putting my California home in a revocable trust trigger reassessment?
No. A transfer into your own revocable living trust is excluded from reassessment under California law. You still file the PCOR with the deed.
