Putting Your House in a Living Trust in San Joaquin County

For a Stockton, Tracy, Lodi or Manteca homeowner, a living trust becomes real at one desk: the San Joaquin County Recorder on North San Joaquin Street, where your trust transfer deed gets stamped into the public record. Here's how recording works in this county, what it actually costs — San Joaquin's first-page fee is higher than the figure most of California quotes — and what probate would take from a typical local home. What it costs to record a trust transfer deed here

San Joaquin's first page is $16.00, not $14.00. The fee rose from $14 on July 1, 2025, and a lot of third-party guidance still quotes the old number. (A separate change on January 1, 2026 raised certified birth, death and marriage certificates by $2 under AB 64 — that one has nothing to do with deeds, and the two get conflated constantly.)

  • Documentary transfer tax — $0 for trust transfers. The county rate is $0.55 per $500 of value, and a transfer into your own revocable trust is exempt under Revenue & Taxation Code §11930. Cite the exemption on the face of the deed.
  • SB2 fee — usually $0. The $75-per-title Building Homes & Jobs fee (cap $225) is waived for transfers to an owner-occupier of a residential dwelling, which covers most primary-residence trust transfers. Declare it on the document. Skip the declaration and the first page jumps from $16 to $91.
  • First page $16, each additional page $3. A typical three-page trust transfer deed with the SB2 exemption declared records for about $22.
  • The $8 fraud fee turns on which deed you use. San Joaquin charges it per title on a specific list of documents — and that list includes quitclaim deeds and gift deeds but not grant deeds. A trust transfer drafted as a grant deed avoids it; the same transfer drafted as a quitclaim costs $8 more and, far more importantly, a quitclaim conveys no warranty of title. Use a grant deed.
  • Non-conforming pages cost more than you'd think. Anything other than 8½ x 11 adds $3 per page of the entire document, not just the offending sheet. Print the whole deed on letter paper.
  • PCOR — file it or pay $20. The Preliminary Change of Ownership Report (BOE-502-A) rides along with the deed. It's free with the filing, and it's how the Assessor knows not to reassess you.

How the deed gets recorded, step by step

  1. Prepare a trust transfer deed — a grant deed, for the reason above — conveying the property from you to you-as-trustee, with the transfer-tax and SB2 exemptions cited on its face and the legal description copied exactly from your current deed.
  2. Complete the PCOR (BOE-502-A).
  3. Sign before a notary — the acknowledgment and seal must be legible and reproducible.
  4. Submit deed + PCOR + fees at the Suite 260 counter or by mail. If you're going in person, aim well before 4:00 p.m.; the counter stays open until 4:30 but anything after 4:00 records the next business day.
  5. Receive the stamped deed back. Document number on, done — the trust now holds the house.

Will this raise my property taxes? (The Prop 13 question)

No. A transfer into your own revocable living trust is not a change in ownership under Revenue & Taxation Code §62(d) — your Prop 13 base-year value is preserved. For a household that bought in Lodi or Stockton before the last two run-ups, that base is worth protecting, and moving the house into your own trust doesn't touch it.

A typical San Joaquin County home runs roughly $500,000. Probate fees under Probate Code §10810 are calculated on gross value, not equity — the mortgage doesn't reduce the fee base, which is the part that catches people out in a county where a lot of homes carry a lot of loan:

San Joaquin County FAQ

Why is San Joaquin's recording fee higher than my neighbour's in another county?
Because it went up. The standard first page moved from $14 to $16 on July 1, 2025. Most California counties still sit at $14 and much of the online guidance was written before the change, so a $14 figure for San Joaquin is simply out of date. Budget $16 for the first page and $3 for each page after it.

Should I use a grant deed or a quitclaim deed?
A grant deed. Two reasons, and they point the same way. San Joaquin's $8 real-estate fraud fee applies to quitclaim deeds and gift deeds but not to grant deeds, so the quitclaim costs more. And a grant deed carries an implied warranty that you haven't already conveyed the property to someone else, which a quitclaim does not.

I got to the counter at 4:15 — why wasn't my deed recorded that day?
The public counter is open until 4:30 p.m., but the recording cutoff is 4:00 p.m. Documents submitted in that last half hour are recorded the following business day. The recording date matters for priority, so if the date is important to you, arrive with time in hand.

Does my mortgage prevent this?
No. The Garn–St. Germain Act prevents lenders from enforcing a due-on-sale clause when you transfer your home into your own revocable living trust. The loan simply continues on the same terms.

I'm moving between counties — does my trust need redoing?
